“The PSR recommends that the court sentence Sam to 100 years in prison. This recommendation is grotesque,” lawyer Marc Mukasey wrote in a statement. sentencing note filed Tuesday, referencing a pre-sentencing report prepared by probation officers.

Mukasey argued that the probation office’s recommendations “significantly exaggerate the seriousness of Sam’s offense, warranting a downward departure.”

According to Mukasey, the victims of the FTX crypto exchange “are about to recover – they have always been ready to recover – a hundred cents on the dollar.”

“The Court should reject the PSR’s barbaric proposal,” Mukasey wrote.

Bankman-Fried, Mukasey said, should instead be sentenced to five to six and a half years in prison. The lawyer said the sentence should take into account Bankman-Fried’s “charitable works and demonstrated commitment to others.”

“A sentence that would quickly return Sam to a productive role in society would be sufficient, but not greater than necessary, to comply with the purposes of sentencing,” Mukasey wrote in the memorandum.

In November, Bankman-Fried was convicted of seven counts of fraud and conspiracy. The disgraced FTX founder faces up to 110 years in prison on these charges. His sentencing is expected to take place on March 28.

Representatives for Bankman-Fried did not immediately respond to a request for comment from Business Insider sent outside of normal business hours.
